1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Manpower Demolition website at manpowerdemolition.ca (the "Site") and the Express Estimator tool (the "Service"), provided by Manpower Demolition Inc. ("Manpower", "we", "us", or "our"). By accessing the Site or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Service.
2. The Express Estimator
The Express Estimator is a tool that allows contractors, developers, and renovators to submit project details and uploaded files to request a demolition estimate. By submitting a request, you authorize Manpower to review your information and contact you regarding your project.
3. Estimates Are Non-Binding
Any figure, range, or estimate provided through the Service is preliminary and provided for general planning and budgeting purposes only. Estimates are not a firm, binding, or guaranteed price and do not constitute a contract for services. A detailed estimate is required for your job. Final pricing depends on a site review, the actual scope of work, site conditions, materials, accessibility, permits, and other factors. No work will be performed until a separate written agreement is signed.
4. Accuracy of Information
You are responsible for the accuracy and completeness of the information and files you submit. Estimates are based on the details you provide; inaccurate, incomplete, or misleading information may result in an estimate that does not reflect the actual cost of your project.
5. Contractor Pro / Paid Access
Some features of the Service may be offered behind a one-time payment (for example, the $37 Contractor Pro unlock). Paid features are provided on a non-refundable basis unless otherwise required by applicable law. Access to paid features does not guarantee the accuracy of any estimate, pricing, or supplier information displayed, and all such information is provided "as is" for your reference.
6. Intellectual Property
All content on the Site, including the Express Estimator, logos, text, graphics, and software, is owned by or licensed to Manpower and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.
7. User Conduct
You agree to use the Site and Service only for lawful purposes and in a manner that does not infringe the rights of others. You may not submit content that is unlawful, harmful, defamatory, or that you do not have the right to share. You retain ownership of the files you upload and grant Manpower a license to use them solely to prepare your estimate.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any estimate will be accurate or complete.
9. Limitation of Liability
To the maximum extent permitted by law, Manpower shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
10. Indemnification
You agree to indemnify and hold Manpower harmless from any claims, damages, or expenses arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
11. Changes to These Terms
We may revise these Terms at any time. The most current version will be posted on this page with a revised "Last updated" date. Your continued use of the Site or Service after changes are posted constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario.
